Terms and Conditions

  1. This View from the Window participatory art project (“the Art Project”) is run by Moreland City Council (‘Council’) in the state of Victoria, Australia only.
  2. By submitting image/s for this project, you declare that you have read and understood the requirements outlined in the terms and conditions and agree to accept them (“terms and conditions”).
  3. If your submission does not comply with these terms and conditions, it will not be valid for inclusion in the Art Project.
  4. Submission to the Art Project is restricted to residents of Victoria aged 18 years and over
  5. The submission period opens from Monday 2 November 2020 and closes on Friday 20 November 2020 at 11:59pm. Submissions received outside of this period will not be accepted.
  6. To participate in the Art Project, submitters must complete the following steps:
    • Submit a landscape-oriented image through the Conversations Moreland.
    • Ensure that your submitted photograph is of a view from the window of a residence within the municipality of Moreland.
    • The photograph must not include images of any person or individual, or other identifying features (see clause 8 for further detail).
    • Images of any person or individual or identifying features will be considered ineligible for the Arts Project.
    • The submitter must also be the person who took the photograph.
  7. The submitter agrees that there will be no monetary compensation (NIL payment) for inclusion of the photograph in the Art Project (and on all social media and Council publications as outlined at clause 10) and the photographer submits their photograph on this basis.
  8. The submission in the form of image/s must not contain any objectionable, offensive, profane, insulting or inflammatory images or language. To ensure the privacy of submitters is protected, submissions must not contain items which may lead to the release of personal information or identification such as, but not limited to, personal identification documents, postal correspondence, phone numbers, Street signs, car license numbers or house numbers and submitters should switch off their geolocation services before posting a photo (if relevant). Council reserves the right to exclude any photographs which, in its reasonable opinion, breaches this condition.
  9. Entrants can submit up to five photographs, provided that each entry complies with the terms and conditions.
  10. By submitting an image to the project, the submitter/ photographer gives Council the right to use the photograph posted in whole or in part in perpetuity and in all media. Photographers names will not be credited in relation to individual photographs, in order to protect privacy. Photographers have the option to have their full name or first name listed in the credits at the end of the film, or to remain anonymous.
  11. All images are shared at the entrant’s discretion. YouTube is a public forum and Council is not able to prevent other users from repurposing posted content. Comments will be turned off on the relevant YouTube page.
  12. Images will be reviewed for suitability for the Art Project, and submission of an image does not guarantee that it will appear in the film. Council reserves the right to remove or delete and exclude from being considered for submission any photograph, which in its reasonable opinion, breaches any of the terms and conditions. Council accepts no responsibility for late, lost, incomplete, invalid or fraudulent submissions.
  13. If insufficient numbers of images are submitted, the film may not go ahead.

Moreland City Council is committed to protecting your privacy in accordance with the Privacy and Data Protection Act 2014 (Vic) and the Health Records Act 2001 (Vic).

The personal information requested is being collected by Moreland City Council for the purposes of your submission to the View from the Window participatory Art Project. Submission to this project will also provide you with the option of being credited in the film (if your image is selected) and being updated by Moreland City Council during the Art Project. Your personal information may also be used to update your personal information otherwise held by Council (for example, contact details including email address, phone number).

The personal information will be disclosed to Moreland City Council’s Arts and Culture Unit and Conversations Moreland. If the personal information is not provided, Council will not be able to contact you to provide an update on the Art Project or provide you with an end credit on the film if your submission is selected.
